Senate Order on Government Agency Contracts
2011 Financial Year Report
Reporting Period 1 July 2010 – 30 June 2011
Pursuant to the Senate Order for Departmental and Agency Contracts (as amended December 2003), the attached table sets out contracts entered into by the Australian Customs Service which provide for a consideration to the value of $100,000 or more and which:
- have not been fully performed as at 30 June 2011 or
- which have been entered into during the 12 months prior to 30 June 2011.
Most of the contracts listed contain confidentiality provisions of a general nature that are designed to protect the confidential information of the parties that may be obtained or generated in carrying out the contract.
The reasons for including such clauses include:
- ordinary commercial prudence that requires protection of trade secrets, propriety information and the like; and/or
- protection of other Commonwealth material and personal information.
This information is provided for each relevant contract listed with the confidentiality arrangements reflecting a standard form contract that existed at the time and nature of many of the contracts in place. Confidentiality clauses in Australian Customs Service contracts have been assessed in accordance with the Department of Finance and Deregulation’s Guidance on Confidentiality in Procurement, July 2007.
One off costs incurred by Customs to comply with this order was approximately $5000. The cost of compliance with the Senate Order was based on the hourly charge out rate for the officers tasked with preparing the information required by the Senate Order.
