Review of the Commerce Trade Description Act

Introduction

A review was conducted of the Commerce (Trade Descriptions) Act 1905 (CTD Act) and the Commerce (Imports) Regulations 1940 (the legislation). In accordance with the requirements of the Competition Principles Agreement (CPA) The report was presented to the Minister for Justice and Customs on 1 November 2002.

The primary aim of the review was to examine, in particular, the effect of the legislation of business and other stakeholders, and to identify possible alternatives to the legislation.

Government is considering its response to the Report.

Final Report

The review committee has completed a final report of the review and it is now available.

As a part of the review, the committee commissioned the Allen Consulting Group to provide an assessment of the economic effects of the legislation. Allen Consulting has prepared a separate report setting out their analysis.
